Overview

This Policy is to help maintain a safe environment for users of TheraisaK.com while helping to protect the intellectual property of the Designer as well as applicable Parties. The Designer takes Canada's Copyright Law (Ref: http://laws-lois.justice.gc.ca) into consideration while creating and operating the website of TheraisaK.com.

Acceptance of Terms

By visiting and otherwise using the website of TheraisaK.com under the ownership of Theraisa K (“Designer”) as displayed and located at the following URL: http://www.theraisak.com; you ("User") are hereby: considered to having read, understood and agreed to the following Policies and are considered to be bound by the Terms and Conditions outlined herein:

The User acknowledges that the Designer will consider the User to having accepted these Terms and Conditions when the follow actions occur:

• The User accesses, uses or otherwise interacts; in any way and in any aspect; with any element or content made available on the website of TheraisaK.com; such as clicking a link, downloading a video, opening a slideshow or otherwise navigating the website; to constitute as full acceptance of these Terms and Conditions.

Amendments

The User acknowledges that from time to time this Agreement will be updated, amended or otherwise modified by the Designer and that it is the User’s sole responsibility to ensure that he/she reads, understands and otherwise agrees to any changes made.

The User acknowledges that the Designer has the right to make any and all changes to this Agreement, without prior notice, and that any changes made are considered to be in immediate effect upon being published to the website of TheraisaK.com.

The User can request at any time to be notified of any changes made, by sending a request to: info@theraisak.com.

Opt-In and Opt-Out Conditions

The User acknowledges that the Designer does not place, send or otherwise subscribe Users to any mailing lists or marketing schemes; if the User wishes to be made aware of any promotions, deals or other he/she may subscribe or otherwise Opt-In to the TheraisaK.com newsletter via the following URL: http://eepurl.com/gFCt (web).

The User acknowledges that he/she can also opt-out of any Third Party services in connection with TheraisaK.com such as newsletter mailings, promotional campaigns or other by following the opt-out information provided with each service or by contacting the Designer at info@theraisak.com with their removal request.

The User acknowledges that he/she can stop using the website and/or services of TheraisaK.com at any time and is not required to inform the Designer of any such decision prior to opting out. Likewise, the User acknowledges that the Designer can at any time and without forewarning cancel, discontinue or otherwise make unavailable the website and services of TheraisaK.com.

Ownership Rights & Usage

The User agrees that this website and all content including work of the Designer, in whole or in part, and in any state or format including digital, originally created, conceptualized or otherwise under ownership of the Designer are protected under the Copyright Act of Canada. (Ref: http://laws-lois.justic.gc.ca).

The User agrees that NO PORTION of this website including its content or the work of the Designer in any state or format may be: published, reproduced, manufactured, copied or made into derivatives, sold, rented, transferred or otherwise used without: obtaining proper licensing and/or written consent from the Designer unless stated otherwise in this Agreement or within the website of TheraisaK.com.

The User acknowledges that he/she is granted the following usage right by the Designer: to use any TheraisaK.com promotional aids such as web banners and graphics, logos and logo marks, including link exchange information and coding only under the condition that these works and content be used:

• Not-for Profit;
• As Promotional Aids with respective hyperlinks returning to http://www.theraisak.com; and that
• No personal information (considered as private and confidential) in the likeness of email address, full name, mailing address, phone number, gender, age, sex or race be disclosed without prior approval from the Designer.

The User acknowledges that all content provided by a Third Party, such as advertisements, external website links, social media icons, logos, hosted scripts or other content, may be protected by intellectual property rights of their original owners and not of the Designer. If the User wishes to use such content for any purpose they must obtain permission from the original owners and not from the Designer.

User Discretion & Prohibited Uses

The User acknowledges that the content published on TheraisaK.com is considered as being published “as is” and that the User is agreeing to access and use the website and services at their own risk.

The User agrees not to hold the Designer responsible or liable for any content displayed or otherwise made available on the website of TheraisaK.com that may be considered malicious, in-appropriate or otherwise offensive (please report any such content to the Designer at info@theraisak.com).

The User agrees not to use the website of TheraisaK.com for harmful or otherwise illegal purposes including: accessing, transmitting or otherwise interfering with the website’s operation, including stealing or otherwise overloading bandwidth usages; and protection including the illegal accessing of protected and/or client reserved areas. The User agrees that these actions are considered as prohibited and are punishable through applicable Laws.

The User agrees not to harvest links or email addresses from this site.

User Information and Disclosure

TheraisaK.com takes Canada's Privacy Act into consideration when dealing with User privacy. The User can obtain our Privacy Policy by visiting the Privacy page of our website at: http://www.theraisak.com/privacy.htm and includes the following additional Terms and Conditions:

The User agrees to provide TheraisaK.com with accurate, up-to-date information when and where it is required; including providing information via a Third Party service such as subscribing to TheraisaK.com’s Newsletter, Blog, News Feed or other or as their policies state.

The User agrees that it is his/her full responsibility to protect any information in the likeness of personal information, user names, passwords, or other security information, numbers and details being transmitted to or from TheraisaK.com including through the use of any Third Party Service. The User agrees to NOT to hold the Designer accountable, liable or otherwise responsible for the misuse, collection, retention or otherwise use of any information of a secure, private or confidential nature.

The User acknowledges that the Designer will not disclose any information considered as personal, private and/or confidential without first obtaining the Users written permission. The Designer holds no responsibility or liability for the way in which any Third Party service directly or in-directly accesses, obtains or otherwise collects and uses the User’s information.

The User agrees that the following information of the Designer’s is considered as confidential and may not be released, disclosed or other wise transferred or used without prior written permission from the Designer:

1. The Designer's Legal and/or Full name;
2. The Designer's age, sex, birth date or race;
3. The Designer's Residential Mailing Address or location;
4. The Designer's Email Address including personal and business addresses;
5. The Designer's Telephone Number including Cell number;
6. and including any other information the Designer has classified as confidential throughout the website and/or via alternate transmissions such as by email, instant messenger, etc.

The User acknowledges that more in-depth information about privacy and information disclosure can be found under the Privacy Policy page (web).

Governing Conditions & Dispute Resolutions

The User agrees that the Designer can be held under the governing laws of Canada.

The User agrees that if Disputes cannot be reasonable resolved between both Parties (between the User and Designer), then the dispute can be submitted to a mutually agreed upon Third Party for mediation; and that if no resolution is obtained, the dispute can then be submitted to a mutually agreed upon Arbitrator. The decision of the Arbitrator will be legally binding.

The User acknowledges that any illegal usage of this website including its contents and including the original works of the Designer are strictly prohibited and punishable by Law and will constitute as a Breach of this Agreement.

The User agrees that he/she has a maximum of 14 (fourteen) days in which to provide a remedy for any moral or legal injustice done to the Designer including any illegal usage of this website, its contents and the work of the Designer by:

• Finding and securing the source of breach;
• Reporting the source to the Designer at info@theraisak.com;
• Undoing, deleting or otherwise removing any material or item from the source;
• If unable to perform an action of removal, the User has up to 48 (fourty-eight) hours to report the source to the Designer at: info@theraisak.com for possible remedy at the Designer's hand;
• Providing a remedy in any other manner obtainable under Law;

Language Conditions:

The User agrees that these Terms and Conditions are provided in the English language and can only be governed under the English language. The User agrees to hold the Designer harmless from any Third Party translation services, programs or other that may modify or otherwise mistranslate the meanings and/or context of this Agreement.

Third Party Liability & Uses

The User agrees to indemnify, save and hold the Designer harmless from all liabilities, costs, damages or other claims, actions or demands made by a Third Party through no fault of the Designer including for the collection, retention or usage of the User's information directly or in-directly created from the website of TheraisaK.com.

The User acknowledges that specific information relating to the usage of Third Party services for collecting and analyzing User trends, website statistics and other can be obtained under the Privacy section of this website and/or at the following URL: http://www.theraisak.com/privacy.htm (web)

The User acknowledges that all information provided by a Third Party is of an anonymous nature.

Agreement Expiration

The Client acknowledges that this Agreement expires when any or all of the following actions occur:

• This Policy is updated, modified or otherwise amended by the Designer;
• The Designer bans or otherwise prevents the User from accessing and/or using the website of TheraisaK.com;
• The User ends or otherwise terminates the use of the website by moving away from the site and/or closing his/her browser window;
• The User ceases to access and/or use the website of TheraisaK.com;

THIS AGREEMENT IS EFFECTIVE AS OF THE MOMENT IT IS PUBLISHED AND DATED ABOVE.

Definitions:

1. "Designer": Refers to Theraisa K;
2. "User": Refers to anything or one that accesses, views or otherwise uses the website of TheraisaK.com;
3. "Website": Refers to all pages including sub-pages, and photo gallery overlays/popups, contained within the registered domain name of http://www.theraisak.com (TheraisaK.com for short) as created by the Designer;
4. "Third Party": Refers to any person, service or other that is either not the Designer or of the Designer's creation;
5. "Information": Refers to any data transmitted to or from TheraisaK.com by any method or means;
6. “Services”: In this case refers to any available action or service in direct relation to the website of TheraisaK.com and does NOT include the actual graphic design or creative services provided by the Designer;
7. "Content": Refers to any visual element displayed on the website of TheraisaK.com including copy, graphics, downloadable content, scripts and coding;
8. "Works": Refers to any piece, masterpiece, product, or handiwork of the Designer's original creation in any format and state;
9. "Party": Refers to the union of the Designer and User whether in whole or in part.
